Berdasarkan Putusan Kasasi Mahkamah Agung Republik Indonesia Nomor 13 K/PID/2017, tertanggal 20 April 2017, Mahkamah Agung secara resmi membatalkan putusan pengadilan tingkat sebelumnya (Pengadilan Negeri dan Pengadilan Tinggi). Dalam putusan tertinggi tersebut, Mahkamah Agung menyatakan Dr. (Commerce) Timotius Tumbur Simbolon, SH., MH., bersama rekan, lepas dari segala tuntutan hukum (ontslag van alle rechtsvervolging) atau tidak terbukti melakukan tindak pidana.

Perkara yang sempat bergulir bertahun-tahun lalu, bermula ketika yang bersangkutan bertindak secara profesional dengan itikad baik sebagai seorang Advokat membela kepentingan hukum klien dalam sengketa keperdataan vs PT Bank Central Asia, Tbk., sebagaimana dijamin dan dilindungi oleh Undang-Undang Nomor 18 Tahun 2003 tentang Advokat. Clarification and Affirmation of Final Legal Status: Dr. (Commerce) Timotius Tumbur Simbolon, S.H., M.H., Declared Released from All Legal Claims by the Supreme Court
JAKARTA — In connection with the ongoing circulation of legacy news reports or digital footprints in the public sphere linking Dr. (Commerce) Timotius Tumbur Simbolon, SH., MH., to past legal matters, legal representatives hereby issue this official clarification and reaffirmation of his final and legally binding (inkracht van gewijsde) status.
Pursuant to the Supreme Court of the Republic of Indonesia Verdict Number 13 K/PID/2017, dated April 20, 2017, the Supreme Court officially annulled the rulings from the lower courts (District Court and High Court). In this highest judicial ruling, the Supreme Court Verdict that Dr. (Commerce) Timotius Tumbur Simbolon, SH., MH., along with his colleague, is released from all legal claims (ontslag van alle rechtsvervolging), meaning he was found not guilty of committing a criminal offense.
